Taxpayer advocate warns taxes could kill the 2nd Amendment

A massive new handgun tax imposed in one U.S. territory could serve as a blueprint for Democrats to ban firearms throughout the country without being shut down by the Constitution.

 

Late last month, a federal judge ruled unconstitutional a 40-year-old total ban on handguns in the Northern Mariana Islands. In the ruling, the judge declared: “[B]ecause the people of the Commonwealth are part of the American people who have overwhelmingly chosen handguns as their principal means of self-defense, the Second Amendment protects that right here as well.”

 

In response to the judge’s order, the territory’s governing body worked out another way to deny residents’ 2nd Amendment rights without constitutional interference. House and Senate lawmakers in the commonwealth quickly passed a harsh 57-page gun control bill which includes a massive $1,000 per pistol excise tax.

 

While the Mariana tax is outrageously high, it isn’t otherwise unique. In fact, it’s one of a growing trend of governmental schemes to raise the cost of guns and ammo with hefty taxes.

 

Just this year, local lawmakers in Seattle opted to place a $25 tax on every gun purchase in addition to taxing every round of ammo sold at between two and five cents depending on caliber.

 

And, according to Americans for Tax Reform head Grover Norquist, Democratic leadership in the White House following 2016 could bring prohibitive taxing schemes aimed at the 2nd Amendment at the federal level.

 

“The Left is now seeking to tax guns out of existence,” Norquist said. “The Second Amendment makes it difficult to legally ban guns, but Hillary has led the way to explaining you can achieve the same thing with high taxes.”

 

Clinton has passionately endorsed the implementation of a 25 percent across the board sales tax on firearms in addition to Obama administration attempts to raise the cost to legally sell firearms to $2,500.

 

“Under the Obama-Clinton model, the cost of selling your best friend a $400 shotgun will be $2,900,” said Norquist.

    Nowwwwwwwwwwwwwwww we’re getting down to the nitty-gritty; If politicians can fill their coffers, they don’t care WHAT gets sold.

    horsehocky– example guns generally have doubled or quadrupled in price under obama–sales are still record breaking every month–a tax would only deter a handful momentarily or till they get their tax refund–
    machine guns cost about 1500 dolars to build they sell for 15-25,000 dollars a piece– isis buys them for 2-400 dollars–the usa has 400 million to 600 million guns that aren’t going anywhere–
    Taxes won’t change a thing but make me very rich–

    This will backfire and badly. Guns are easy to make and ammunition is easier to make. People won’t buy guns they will make them. This will take guns off the grid. Nobody will register them and no taxes will be collected. I’ll pay sales tax on my guns to a point but if you tell me it’s $1,000 in tax on a $700 pistol you can go screw yourself, I’ll just make it.

    Shall not be infringed covers this aberration. Those who propose things like this and have taken an oath to uphold the constitution are liars and traitors. They have no constitutional authority to infringe upon the right of a law abiding citizen to own and bare arms, regardless of the hypocritical methods used to achieve this end.

    The groundswell of indignation within the hearts of freedom loving people will only be lifted higher by the repression of the pompous elite. When asked to trade money for the tools of liberty there will not be any hesitation. Money is the symbol of the debt slavery offered by the banksters and the elite. Freedom is in the hearts and minds of the people. The present tyranny like so many that have come before will be crushed under the weight of the corruption it wallows in. It will be a pleasure to return the currency of the corrupt. Other items with value will replace it. A new day, a new paradigm is coming. The light is coming and the darkness will not understand it.

    It will generate a black market not just for guns but ammunition, magazines, infrared scopes, even silencers. When the logistics are in place they’ll sell police and military arms – missile launchers, mortars, grenades, anti-riot rounds etc.

    It might establish the arms industry which goes on to supply the civil war.

    Read the tax law and wake up. The federal income tax is an excise tax. That means a tax on privileged activities like working for the federal government or exercising a federal privilege or using government monies in which you receive a benefit. You cannot be taxed for your mere common right to earn a living in the private sector if you have not engaged in any federal excisable activity. If the government could just dictate what percentage, then any amount no matter how small they demand from you under the red herring of “paying your fair share”, would constitute indentured servitude also known as slavery. Last I checked slavery is unlawful and illegal in our Republic. The Sixteenth Amendment, contrary to government promoted propaganda, could not and did not change the taxing clauses of the Constitution. The Supreme Court has already confirmed this in several cases. Legal terms in law have specific limited meanings that are completely different from the common words we use every day. The Sixteenth Amendment simply cleared up some confusion about gains received from dividends and rents from the exercise of federal privilege with federal monies. It put those “sources” of “income” in the category of direct taxes not needing apportionment. That is ALL! It did not give Congress any new power to take half of your unprivileged private sector earnings from your paycheck. So why the confusion? Ask yourself who benefits from our ignorance? Remember legal terms used in law have completely different meanings than common terms and words. Under the tax code “employee, employer, wages, trade or business” have no bearing on most of us who pursue occupations of common right in the private sector whether you’re a doctor or a burger flipper. The 1040 actually constitutes a claim for refund of everything that was withheld from your paycheck including social security and Obama care taxes. You just have to understand who the law actually applies to and fill out the correct IRS Forms to get all your donated money back if you have not engaged in excisable activity (federal privilege) thus requiring you to pay a Federal Income tax. This is one of the biggest misunderstandings about the Federal Income Tax. If you have no liability then why do you keep giving your money away? Well people are finally correcting their errors and getting all their money back for years now. The educational information is spreading. Forget you ever read this, keep drinking the red, white and blue Kool-Aid and continue to be duped by those who benefit from your ignorance or start the path to understanding the law by reading it yourself.
